Q28: How does the Migration Regulatory Scheme work?

The regulatory scheme is part of the Migration Act 1958 (the Act) and the Migration (1994) Regulations. The central notion is that in order to enter Australia legally, a person must hold a visa. A visa enables a non-citizen to:

• Travel to and enter Australia
• Stay in Australia

A visa is not a document; evidence of the existence of the visa is usually a stamp in a person's passport.
