How to Inform a Immigration Detention Review Officer

Under migration practice a Detention Review Officer is informed of an application when they receive a:

  • copy of the page of the substantive visa application which incorporates the bridging visa application or
  • copy of the Notice of Lodgment of Bridging Visa E Application
  • completed form 1008 faxed to the relevant DRO. For those clients not in a place of Detention occupied by an Immigration Officer
  • letter, fax or email stating that an application for BVE has been made

Upon forwarding written notice of a BVE application to a DRO, an immigration officer generally then follows up verbally to ensure that the written notice has been received.

Once the DRO has been informed of the application for a BVE, they are then responsible for creating a file note that states the time and date they were informed of the application. The file note should also clearly state the name and the position number of the DRO. This record must be placed on the applicant's file and relevant records should be created.

All are essential in the proper execution of the application process by Immigration officers, and can be important considerations if concerns of lack of due process are entertained by affected visa applicants and/or visa holders.
