ASCO-ANZSCO Immigration Occupation Framework Applied In Skills Assessing

An immigration case officer/delegate must be satisfied that an applicant's occupation claimed in fact exists, despite a positive pre-migration assessment has been submitted with the visa application.

And, if appropriate, whether specific employment in fact exists.

Under immigration policy, the system used for classifying visa applicants (and, if applicable, visa holders) by occupation, is the Australian Standard Classification of Occupations (ASCO) and Australian and New Zealand Standard Classification of Occupations (ANZSCO), which currently classifies all occupations in the Australian labour force.

The ASCO-ANZSCO system was developed as an Australian national standard for the production and analysis of labour market statistics, human resources management, education planning, the listing of job applicants and vacancies, the provision of occupational information, conducting social and epidemiological research and for vocational guidance.

ASCO-ANZSCO occupational classification is founded on the concepts of skill level and skill specialisation, that is:

  • Skill level is defined as the range and complexity of the set of tasks involved. It is measured operationally as the degree of formal education, on-the-job training, and by previous experience required to perform the duties of an occupation
  • Skill specialisation is defined in terms of the field of knowledge required, the tools and equipment used, the materials worked on and the goods and services produced

The structure of ASCO-ANZSCO has four levels: major group, minor group, unit group and occupation.

Reference documents used to classify occupations into ASCO codes include:

  • The ASCO-ANZSCO Dictionary
  • ASCO-ANZSCO Statistical Classification
  • ASCO-ANZSCO Occupational Definitions
  • ASCO-ANZSCOO codes

An immigration case officer must however not apply the ASCO-ANZSCO inflexibly without having regard to the specific facts of an applicant's case.

There are many instance, where this has resulted in a wrong decision at law or acting beyond powers. For example: covering former concepts of 'usual occupation' and paying 'lip service' to the Skilled Occupations List (and other gazetted lists for temporary and permanent residence) - in a manner of form not substance - without having regard to the nature of the duties and tasks performed by the visa applicant against the legislative criterion.
